The construction of a four-storey residential building adjacent to the former residence of the late Chief Gani Fawehinmi, a prominent Nigerian lawyer and human rights activist, has sparked controversy and allegations of regulatory violations. Loyalists and associates of the late Fawehinmi staged a protest, claiming the building encroached on Fawehinmi’s property, violated mandatory setback regulations, and posed a safety hazard due to falling water tanks. The developers, Nouveau Projects Ltd., acting on behalf of the landowners, vehemently deny these accusations, asserting that the construction adheres to all necessary approvals and regulations stipulated by the Lagos State Government.

Nouveau Projects Ltd. presented documentation to support their claims, including an authorization to commence construction issued by the Lagos State Building Control Agency (LASBCA) and a development permit from the Lagos State Physical Planning Permit Authority. These documents, according to the developers, demonstrate their compliance with all regulatory requirements. A site inspection revealed that while the building might appear from the outside to have an inadequate setback, internal measurements show sufficient clearance from the Fawehinmi property, conforming to the approved building plan. The developers also highlighted the secure reinforcement of the rooftop water tanks, designed to prevent any potential accidents.

The developers, through their representative, Mr. Morakinyo Abolude, Head of Projects at Nouveau Projects Ltd., condemned the accusations as an attempt to exploit the revered name of Chief Gani Fawehinmi to intimidate them. They emphasized that the building is a fully occupied residential apartment complex, not a hotel as rumored, and its construction has been duly approved by the Lagos State Government. They further reiterated their meticulous adherence to regulatory procedures, including obtaining necessary permits and undergoing stage-by-stage certifications from LASBCA throughout the construction process. The developers characterized the allegations as baseless and an attempt to unjustly tarnish their reputation.

Addressing the specific allegation of falling water tanks, the developers clarified that during construction, they discovered structural weaknesses in the perimeter fence separating the two properties. They subsequently, in consultation with the Fawehinmi family’s estate managers, financed the construction of a new, more robust fence. They assert that this action demonstrates their commitment to maintaining good neighborly relations and ensuring the safety of the adjoining property. The ongoing dispute, according to the developers, is already subject to legal proceedings, with the Fawehinmi family having filed a lawsuit against both the developers and the Lagos State Government. They expressed surprise that the family has resorted to public campaigns despite the matter being before a court of law.

The developers appealed for an end to what they perceive as harassment and urged all parties to allow the legal process to unfold. They underscored their respect for the late Chief Gani Fawehinmi and his contributions to justice and equity, expressing irony that his name is now being used, in their view, to obstruct lawful processes. The developers maintained their confidence in the judicial system to resolve the dispute fairly and impartially based on the evidence presented.

Meanwhile, LASBCA has confirmed its involvement in investigating the matter. The agency’s Public Relations Officer, Adu Ademuyiwa, stated that LASBCA had visited the site, issued necessary notices, and instructed the developers to address any identified contraventions. This intervention by LASBCA indicates that the regulatory body is actively monitoring the situation and taking steps to ensure compliance with building regulations. The agency’s ongoing investigation suggests that the dispute is far from resolved and that further scrutiny of the construction project is underway. The outcome of both the LASBCA investigation and the pending lawsuit will ultimately determine the validity of the allegations and the future of the contested building.
