The Edo State Governorship Election Petition Tribunal commenced proceedings on Monday, January 13, 2025, to address the petition filed by Dr. Asue Ighodalo, the Peoples Democratic Party (PDP) candidate, challenging the victory of Governor Godwin Obaseki in the September 21, 2024, governorship election. Dr. Ighodalo contested the election results, which declared Governor Obaseki of the All Progressives Congress (APC) as the winner with 291,667 votes, while he garnered 247,274 votes. The tribunal’s primary objective was to examine the evidence presented by the petitioner and determine the validity of the election outcome.

The inaugural session witnessed a request for adjournment from the legal representatives of the Independent National Electoral Commission (INEC) and Governor Obaseki, the first and second respondents respectively. Dayo Dahunsi, the Assistant Secretary to the tribunal, informed the court of the application, citing the lead counsel’s engagement with a Supreme Court case scheduled for definitive hearing on Tuesday, January 14, 2025. The respondents’ counsel further emphasized that this request extended to other petitions challenging their clients before the tribunal, highlighting the potential for scheduling conflicts and the need for coordinated proceedings.

In response to the adjournment application, Oladipo Oshinowo, representing the petitioners’ lead counsel, Ken Mozia (SAN), expressed his willingness to cooperate, acknowledging the late notification of the request. While emphasizing their preparedness to proceed with the trial, the petitioners’ counsel conceded to the adjournment based on the understanding that future requests of this nature would not be entertained. This stipulation aimed to ensure the timely and efficient resolution of the petition, preventing unnecessary delays and safeguarding the integrity of the electoral process.

Josephine Ogagaworia, counsel for the third respondent, the All Progressives Congress (APC), did not oppose the adjournment application, aligning with the respondents’ position and facilitating the rescheduling of the proceedings. Justice Kpochi, presiding over the tribunal, subsequently adjourned the hearing to Wednesday, January 15, 2025, paving the way for the commencement of the substantive hearing of the petition. This adjournment provided all parties with the necessary time to prepare their arguments and evidence, ensuring a fair and comprehensive examination of the electoral dispute.

The adjournment also underscores the complexities of legal proceedings, particularly in election-related disputes. The involvement of multiple parties, each with their own legal representation, requires careful coordination and scheduling to ensure a smooth and efficient process. The tribunal’s decision to grant the adjournment reflects a commitment to fairness and due process, allowing all parties ample opportunity to present their case and ensuring a thorough examination of the evidence before reaching a final determination.

The Edo State Governorship Election Petition Tribunal plays a crucial role in upholding the integrity of the electoral process. By adjudicating disputes and examining evidence, the tribunal ensures that elections are conducted in accordance with the law and that the will of the people is respected. The outcome of this petition will have significant implications for the political landscape of Edo State and will serve as an important precedent for future electoral disputes. The tribunal’s commitment to transparency and due process is essential for maintaining public trust in the electoral system and ensuring that democratic principles are upheld.
