The Arrest and Remand of Ghali Isma’il: A Case of Alleged False Information and Incitement

On Friday, July 26, 2025, an Abuja Chief Magistrate Court ordered the remand of Ghali Isma’il, a 29-year-old social media influencer, at the Keffi Correctional Centre. Isma’il, known by his TikTok handle @bola_asiwaju, faces charges related to the dissemination of false information concerning President Bola Tinubu’s health. The court proceedings, presided over by Judge Ekpeyong Iyang, saw Isma’il arraigned on two counts: publication of false news with intent to cause offense against public peace and inciting disaffection against the government.

The prosecution argued that Isma’il, on or around July 20, 2025, uploaded a video on his verified TikTok account falsely claiming that President Tinubu was critically ill due to poisoning. This act, according to the prosecution, was intended to cause public alarm and disrupt public peace, constituting an offense under Section 418 of the Penal Code Act. The second charge accuses Isma’il of intending to bring contempt or incite disaffection against the President through his actions, an offense punishable under Section 416 of the same act.

Following arguments from both the prosecution and defense counsel, Judge Iyang denied Isma’il’s bail application, leading to his remand at the Keffi Correctional Centre. The case has been adjourned to August 19, 2025. This incident highlights the growing concern over the spread of misinformation on social media platforms and its potential impact on public order and political stability.

Contextualizing the Case: Other Instances of Controversial Online Content

Isma’il’s case coincides with other recent instances of individuals facing scrutiny for potentially harmful online content. Days before Isma’il’s arraignment, Farooq Kperogi, a journalism professor at Kennesaw State University in the United States, issued a public apology for falsely reporting the divorce of former President Muhammadu Buhari and his wife, Aisha, at the time of Buhari’s death. This incident underscores the potential for misinformation to rapidly spread and gain traction online, even from seemingly credible sources.

Furthermore, the case of Simon Ekpa, a Biafran separatist agitator, further illustrates the challenges of regulating online speech. Ekpa is currently on trial in Finland for terrorism-related offenses linked to his online activities. Ekpa, however, contends that his controversial posts were merely intended as “content,” raising questions about the intent behind online pronouncements and the line between free speech and potentially harmful rhetoric. In a similar vein, Nnamdi Kanu, another Biafran separatist leader, argued in a Federal High Court that his online broadcasts, which prosecutors link to the deaths of hundreds, were meant as jokes. The Finnish authorities are seeking a six-year sentence for Ekpa, arguing that his actions potentially constitute terrorism under Finnish law.

The Broader Implications: Misinformation, Social Media, and Legal Accountability

These cases collectively highlight the complex interplay between freedom of expression, online platforms, and legal accountability. The rapid dissemination of information on social media platforms presents challenges for both individuals and governments in discerning truth from falsehood and in mitigating the potential harms of misinformation. The legal frameworks governing online speech are still evolving, as courts grapple with defining the limits of acceptable online behavior and determining the appropriate consequences for those who cross those lines.

The Isma’il case, along with the examples of Kperogi, Ekpa, and Kanu, underscore the need for increased media literacy among users of social media platforms. Critical evaluation of online information is crucial to avoid falling prey to misinformation and contributing to its spread. Furthermore, these cases raise important questions about the responsibility of social media companies in regulating content and combating the spread of false or harmful information. Striking a balance between protecting free speech and preventing the spread of misinformation remains a significant challenge in the digital age.

Navigating the Challenges of Online Speech: A Multifaceted Approach

Addressing the complex issue of online misinformation requires a multifaceted approach. Education plays a crucial role in equipping individuals with the skills to identify, analyze, and evaluate online content. Promoting media literacy and critical thinking skills can empower individuals to make informed judgments about the information they encounter online. Furthermore, social media platforms themselves bear a responsibility to implement effective content moderation policies and to invest in technologies that can detect and flag potentially false or harmful information.

Legal frameworks also need to adapt to the evolving online landscape. Clear and consistent laws are necessary to define the limits of acceptable online behavior and to hold individuals accountable for spreading misinformation or inciting violence. However, such laws must be carefully crafted to avoid infringing on legitimate expressions of free speech. Striking this balance is crucial to maintaining a healthy online environment.

The Role of Governments and International Cooperation

Governments also have a role to play in combating the spread of misinformation. This includes supporting media literacy initiatives and working with social media companies to develop effective content moderation policies. International cooperation is also essential, given the global nature of the internet. Sharing best practices and coordinating efforts to combat misinformation can enhance the effectiveness of these efforts.

Looking Ahead: The Future of Online Speech and Information

The cases of Isma’il, Kperogi, Ekpa, and Kanu are indicative of the ongoing challenges posed by online speech and the spread of misinformation. As social media platforms continue to evolve and become increasingly integrated into our lives, the need for responsible online behavior and effective regulatory frameworks will only grow. Addressing these challenges requires a collaborative effort involving individuals, social media companies, governments, and international organizations. By working together, we can strive to create a more informed and responsible online environment.
