A group of seven Liberian Representatives, loyal to embattled Speaker J. Fonati Koffa, have filed a petition with the Supreme Court challenging the withholding of their salaries and benefits by the executive branch. These Representatives, constituting the minority bloc within the House, were suspended by the rival majority bloc, led by self-proclaimed “Regime Speaker” Richard N. Koon, for boycotting legislative sessions following the disputed removal of Speaker Koffa. The Representatives argue that their suspension and the subsequent withholding of their salaries are illegal and politically motivated, constituting an unfair punishment for their refusal to recognize the legitimacy of Speaker Koon’s leadership. The petition requests a writ of mandamus compelling the Ministry of Finance to release their withheld payments.

At the heart of the dispute lies the controversial removal of Speaker Koffa, an action deemed “ultra vires” (beyond legal authority) by the Supreme Court of Liberia. Despite the court’s ruling mandating a return to the status quo ante and adherence to legal procedures for leadership changes, the majority bloc, allegedly with the backing of President Joseph Boakai’s administration, has continued to operate under Koon’s leadership. They contend that the withholding of their salaries is not based on any legal grounds but is a direct consequence of political maneuvering by the majority bloc seeking to punish them for their loyalty to Speaker Koffa and their challenge to the legitimacy of Koon’s leadership.

The Representatives’ petition to the Supreme Court underscores the ongoing power struggle within the Liberian House of Representatives. The majority bloc’s actions, including the forced entry into Speaker Koffa’s office and the removal of his belongings without a warrant, coupled with the suspension of the dissenting Representatives, highlight the disregard for legal processes and the escalating tensions between the rival factions.
