This case revolves around a dispute between Ahmed Rabiu, a passenger, and Virgin Atlantic Airways concerning lost luggage. Rabiu alleges that the airline lost his luggage on a flight from London to Lagos on September 24, 2024, and has failed to compensate him or replace the lost items, despite their claims to the contrary. He asserts that he complied with all necessary procedures, reporting the loss immediately upon arrival and completing the required paperwork. Despite these efforts, the airline has not returned his luggage, offered replacement items, or provided compensation for the value of the lost contents. This failure, Rabiu contends, represents a breach of contract and has caused him significant distress and inconvenience, leading him to seek legal redress.

Rabiu’s claim details his experience, from the initial check-in and tagging of his luggage in London to the disheartening discovery in Lagos that his bag was missing. He describes waiting at the baggage carousel until it was deactivated, the last passenger left stranded without his belongings. Immediately reporting the loss to Virgin Atlantic staff, he diligently completed the provided Loss of Baggage Form, expecting a resolution. However, his attempts to recover his luggage or receive compensation have been unsuccessful. He subsequently instructed his lawyers to send a demand letter to the airline, reiterating his request for the return of his luggage or payment for its contents, but this too yielded no results.

The core of Rabiu’s argument rests on the airline’s alleged breach of contract. He argues that his purchase of a ticket implied a contractual agreement that his luggage would be transported safely and delivered to him upon arrival. The airline’s failure to fulfill this obligation constitutes a breach of contract, entitling him to compensation. He claims damages not only for the value of the lost items, totaling $4,000, but also for the distress, inconvenience, and legal fees incurred in pursuing the matter, amounting to N20 million. He further dismisses the airline’s defense as a delaying tactic designed to evade responsibility for their negligence or recklessness.

Virgin Atlantic Airways, in its defense, disputes Rabiu’s claims and argues that the passenger’s failure to provide sufficient information on the Property Irregularity Form hindered their ability to trace the luggage. They deny the allegations of fraud, recklessness, and negligence on their part or that of their staff and agents. The airline contests the amount of damages sought by Rabiu, asserting that even if they were found liable, their liability would be limited by the Montreal Convention 1999, incorporated into the Nigerian Civil Aviation Act 2023. This convention establishes limitations on an airline’s liability for lost or damaged baggage, aiming to standardize international air travel regulations.

The crux of the legal disagreement lies in the interpretation of responsibility and the applicable regulations. Rabiu argues that Virgin Atlantic is liable for the loss of his luggage and the subsequent damages, while the airline contends that their liability is limited by international conventions and dependent on the passenger’s adherence to reporting procedures. The court will consider the evidence presented by both parties, including Rabiu’s testimony, the airline’s defense, and any relevant documentation. The judge’s decision will determine whether Virgin Atlantic Airways is liable for the loss of Rabiu’s luggage and the extent of their financial responsibility. This case highlights the complexities of air travel disputes and the importance of clear communication and adherence to established procedures in resolving such issues.
